The RIAA has accused Internet giant Google of refusing requests to remove MP3 Music Download Pro, an popular Android app which allows users to download copyrighted music onto their Android phones. The app is the fourth most popular free Android app, ranking above Angry Birds, which is currently No. 5.
The app describes itself as follows:
search and downlaod (sic) music and lyric and Album cover.
manage music: play | delete | set as Ringtone notification.
multi-thread download, you can download 3 songs at the same time.
Despite being a "pro" app, which normally translates into paid, it's a free app.
"We sent a takedown notice to Google in August for this particular app, which is clearly being used for illegal purposes, and Google responded that they were declining to remove it from the Android Market. We continue to have concerns with Google's screening and takedown procedures and hope that they will be improved."
The big question is why this has become semi-headline news at this point. A search of the Android Market at any time will bring up tons of free apps that are used to download music in a similar manner to this one. In fact, if you search for MP3 Music Download Pro in the Android Market, you will find the results include FOUR versions of the app, all by the same author, although one calls itself V2.
We've seen MP3 download apps come and go rapidly in the Wild Wild West that is the Android Market. If one is removed, another by the same author appears. Or, as in the case of the MP3 Music Download Pro app, the author will place several versions in the Android Market at once, seemingly just in case one of them is removed.
Steven Marks, the executive vice president and general counsel at the RIAA said,
"Google has taken down some mobile apps that facilitate infringement, but the takedown times are long, and too often we see the same or substantially similar apps from the same developers re-appear a few days later. Google could also take a more proactive role by screening and evaluating apps before they are made available. Most importantly, too many apps created to harvest links to unauthorized files remain available and popular on the Android marketplace, resulting in widespread infringement of copyrighted works."
One has to wonder if, when Google launches its online music store, it will become more strict and vigilant at going after these apps.
Not even Walmart could beat iTunes. On Tuesday, the giant retailer admitted defeat, and said that at the end of the August, it will close its MP3 download store.
Officially, the store will shutter at the end of the day on August 29. While Walmart was able to undercut iTunes' pricing for tracks, it had several minuses compared to Apple's iTunes store.
First, and foremost, it didn't have a tightly integrated software / hardware solution for its product. No "Walmart iPod" and no "Walmart iTunes program" to organize, transfer, and buy tracks with.
Next, when the store debuted in December 2003 (officially launching in March of 2004), tracks were only available in Microsoft's DRM-protected WMA format, which meant the music was unusable for iPod owners.
Finally "catching on" somewhat, Walmart adopted the DRM-free MP3 format, in 2007, but it also saw Amazon.com open its Amazon MP3 store that year. Perhaps fueled by the fact that the Internet retailer had tons of visitors for the rest of its "catalog," Amazon MP3 caught on while Walmart's MP3 store did not, and by 2008 Amazon.com had passed Walmart to become the second largest online music store.
Even with that, not even Amazon.com has not been able to make a "serious" dent in iTunes' market share. Recent forays into cloud-based music storage and playback by both Google and Amazon.com were rushed, in an attempt to beat Apple's cloud service (iCloud, coming soon with iOS 5), but in both cases, neither service managed to sign deals with music labels.
Apple has something no other music store has been able to achieve: a tightly integrated hardware and software solution to go along with the store. Not even Google's Android platform has that, although some have pointed to doubleTwist as something Google should look into acquiring, along those lines.

iTunes overwhelmingly has the lead in downloadable music, with Amazon MP3 a distant second. Will lowering its prices, effectively starting a price war with iTunes, make a difference?
Amazon MP3 now prices select hot-selling tunes for 69 cents, down from 89 cents previously. Many of the songs in Amazon's 69-cent store sell for $1.29 on iTunes. However, if they couldn't make a move on iTunes' market share with a $0.40 price advantage, will an extra 20 cents win them market share?
Among the songs that Amazon MP3 buyers can save nearly 50 percent on include, Katy Perry's "E.T.", Jennifer Lopez's "On the Floor," The Black Eyed Peas' "Just Can't Get Enough," and Lady Gaga's "Born This Way."
Amazon MP3's digital download music market share sits at about 10 percent. Apple's iTunes continues to have about 70 percent of the digital download music market, according to the NPD Group.
In 2010, Apple went to a tiered pricing model. New releases went to $1.29 each, up from 99 cents. Despite that, Amazon MP3 continued to toddle along at 10 percent.
Some of this, of course, is because it is so easy to buy from iTunes, and load it onto your iDevice. However, Amazon.com has an MP3 downloader that takes any MP3s you buy from them and slaps it right into your iTunes library, without an issue. Considering the near 50 percent price difference, isn't Amazon MP3 worth a look?
